DMCA Policy

War Machine Review is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, War Machine Review will respond expeditiously to claims of copyright infringement committed using the War Machine Review service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent.

This policy describes the information that should be present in a notification of alleged infringement, as well as the information that should be present in a counter-notification. It is designed to make the process of reporting and resolving alleged copyright infringement clear and efficient.

Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the War Machine Review website, please notify our designated Copyright Agent as set forth in the Digital Millennium Copyright Act (DMCA). Your notification must include substantially the following:

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identify the material that you claim is infringing (or the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) of the specific content).
  3. Provide your contact information, including your full legal name, an address, telephone number, and, if available, an email address.
  4. Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Provide your electronic or physical signature (typing your full legal name is sufficient for electronic submissions).

Filing a DMCA Counter-Notification

If you believe that material you posted on War Machine Review was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing our Copyright Agent with the following information:

  • Identify the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  • Provide your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which War Machine Review may be found), and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
  • Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Provide your physical or electronic signature (typing your full legal name is sufficient for electronic submissions).

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA Takedown Notice. If that party does not file a court action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system within 10 business days of receiving the counter-notice, the removed material may be replaced, or access to it restored, at our sole discretion.
